College of Law dean Vikram Amar, along with Akhil Reed Amar and Steven Calabresi, filed a brief on October 24, 2022 in support of respondents in the Supreme Court case Moore v. Harper. The case involves a claim by North Carolina legislators that under the Constitution only the legislature of a state has the power to regulate federal elections, without any interference from state courts or any constraints from state constitutions. The brief demolishes this so-called "independent state legislature" theory, to the extent that it attracted the attention of NPR legal affairs correspondent Nina Totenberg, who called it "scorching" and prominent retired Republican jurist J. Michael Luttig, who said the brief would be "of inestimable, if not determinative, value to the Supreme Court."
