Professor Suja Thomas was a panelist at the American Constitution Society annual convention on June 10, 2016. The panel discussed the rise of arbitration clauses in consumer contracts and the future of class actions. The National Law Journal covered the panel, and quoted Thomas as saying:
"The rise of arbitration has also contributed to the decline in jury trials. Plaintiffs tend to fare better in front of juries than in arbitration. Arbitrators are often pulled from the private bar and, as a result, aren't representative of the general public."
