Professor Suja Thomas has been vocal about her concerns over Duke Law Center for Judicial Studies’ involvement in publishing guidelines on the application of new discovery rules that limit discovery: “That effort improperly blurs the lines between a private initiative and the official rule making and training process for judges.”
Recently, the American Bar Association's Litigation Section and Duke Law Center for Judicial Studies launched the Rules Amendments Roadshow, a 17-city tour to discuss changes to the federal rules of civil procedure that took effect last December. Professor Thomas' concerns were highlighted in an article in the Massachusetts Lawyers Weekly. "Through funding, corporations have successfully lobbied academics and judges to define this proportionality rule in their favor."
