On February 25, 2016, Professor Michael Moore gave the 49th Annual Brainerd Currie Lecture at the Duke University School of Law in Durham, North Carolina.
The title of Moore's Lecture was, "The Elusive Quest for a Constitutional Right to Liberty." In the Lecture Moore used the recent same-sex marriage decision of the U.S. Supreme Court, Obergefell v. Hodges, as a springboard for a general discussion of the nature of the right to liberty, both as a natural right and as a right guaranteed under our Constitution.
Along the way Moore also discussed the role of judges in using their own best moral insights as they interpret constitutional rights such as the right to liberty.
