Professor Ralph Brubaker, in collaboration with Professors Bruce Markell (Northwestern Law), Charles Mooney, Jr. (Penn Law), and Mark Roe (Harvard Law), has submitted an amici curiae brief in support of respondent in 16-784, Merit Management, LP v. FTI Consulting, Inc.
The case is currently pending before the Supreme Court of the United States.
In the brief, the professors ask the Court to clarify the intent of the safe-harbor provision at issue, which will serve to "faithfully implement the statutory language and advance the sound policy objectives Congress intended."
