During the spring 2021 semester, Immigration Law Clinic student and rising 3L Nick Rohm worked alongside private attorney John “Jack” Wilke in an effort to convince the Chief Judge of the 6th Circuit in Illinois to rescind Administrative Order 95-7. The Order mandated that probation officers alert Immigration and Customs Enforcement (ICE) any time a noncitizen complied with a probation order, resulting in numerous administrative arrests of nonviolent immigrant probationers. Nick conducted legal research to formulate arguments against this Order and to identify state legislation that demonstrates that this Order contravenes the state of Illinois’s repeated efforts to discourage and/or eliminate state law enforcement agencies’ cooperation with ICE. The student assisted in the drafting of the collaborative letter which was submitted for the consideration of the current Chief Judge on May 5, 2021. On June 3, 2021, after considering our letter and current Illinois law related to the issue, Judge Rosenbaum rescinded Order 95-7.
