Subject: Department of Labor Final Ruling on Fair Labor Standards Act Changes
The U.S. Department of Labor issued its final rule changes related to overtime exemptions under the Fair Labor Standards Act (FLSA). Effective January 1, 2020, employees who make less than $35,568 annually will be considered non-exempt under FLSA rules and will be eligible for overtime pay.
To be exempt from overtime under FLSA, employees must be paid a salary of at least the threshold amount and meet certain duties tests. If they are paid less and do not meet the duties test, they cannot be considered exempt from FLSA and thus are eligible for overtime pay.
A system-wide committee is reviewing the impact on University of Illinois System employees, policies, systems, and processes. If you currently have exempt employees in your department/unit who make less than $35,568, your system or university human resources office will contact your human resources representatives to discuss the impact to your college/department and employees.
